Using Our Services

You must be at least 18 years old or have a parent or guardian's permission to place an order. You agree to provide accurate, current information when ordering, including a valid phone number and pickup or delivery address.

You may not use the site to place fraudulent orders, submit false information, or disrupt our operations. We reserve the right to refuse or cancel any order at our discretion.

Orders, Pricing & Availability

All menu items, market products, and services are subject to availability. Prices are listed in U.S. dollars and may change without notice. We make every effort to display accurate pricing, images, and descriptions, but errors may occur — if an item's price is materially wrong, we will contact you before fulfilling the order or cancel and refund it.

Grill items and prepared foods are available for pickup or local delivery in the Ruidoso area. Select market products ship nationwide. Some items cannot be shipped due to perishability.

Payments

Payments are processed securely through Base44 Payments. By placing an order you authorize us to charge the payment method you provide for the total shown, including applicable taxes and any gratuity. Minimum online charge is $0.50.

Pickup & Delivery

• Pickup orders are prepared at our Ruidoso location — please arrive during the selected window.
• Local delivery is offered within a defined service area for an additional fee, shown at checkout.
• We are not responsible for delays caused by incorrect addresses, unreachable recipients, or circumstances beyond our control.
• Perishable items should be refrigerated promptly; we are not liable for spoilage after successful delivery or pickup.

Shipping & Returns

Shippable market products are sent via standard carriers. Estimated delivery times are not guaranteed. If a shipped item arrives damaged or incorrect, contact us within 7 days with a photo and we will arrange a replacement or refund.

Due to the nature of food products, prepared foods and perishable items are non-returnable unless they arrive damaged or incorrect. Unopened, non-perishable market goods may be returned within 14 days of delivery for a refund of the product price (shipping is non-refundable).

Catering & Private Chef

Catering and private-chef services are quoted individually based on guest count, menu, location, and service level. A deposit may be required to reserve a date. Final guest counts, menu changes, and cancellations are governed by the proposal or agreement provided for your specific event.

Private-chef and catered events held at a rental property are subject to that property's rules and the host's permission; you are responsible for securing access and any required approvals.

Accounts

When you create an account, you are responsible for keeping your password confidential and for activity under your account. Notify us immediately of any unauthorized use. We are not liable for losses from compromised credentials you failed to protect.

Intellectual Property

All content on this site — including the New MexiGO name, logo, menu text, photography, and design — is owned by New MexiGO Market Grill and protected by intellectual property laws. You may not copy, reproduce, or redistribute it without our written permission.

Limitation of Liability

To the fullest extent permitted by law, New MexiGO Market Grill is not liable for indirect, incidental, or consequential damages arising from your use of the site or services. Our total liability for any claim is limited to the amount you paid us for the order or service giving rise to the claim.

Third-Party Links

Our site may link to third-party sites and services (lodging directories, travel guides, maps) we do not control. We are not responsible for their content, policies, or practices.

Changes to These Terms

We may update these Terms from time to time. The updated date at the top of this page reflects the last revision. Continued use of the site after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Mexico, USA. Any disputes will be resolved in the courts located in Lincoln County, New Mexico, or as otherwise required by law.
